Implementation of this Crime against America,

There will be two votes in the Senate; the first will be Friday Morning, 9\/27<\/span>.\u00a0 This vote will make it seem that all 46 Republicans are voting to defund Obamacare – don’t believe this<\/span> ruse!<\/span><\/strong><\/p>\n

Reid and the Democrats (and Socialist Bernie Sanders) MUST<\/span> garner

It is the Democrats who are holding the government hostage to defend the “Train Wreck<\/span>” that is Obamacare, in the words of their own colleague, Max Baucus, who was the principal author of the Bill.<\/span><\/span><\/strong><\/p>\n

If you want your senators to vote to defund Obamacare NOW<\/span>,
\nthey MUST stand on principle, trust God, and
\nVOTE NO<\/span><\/em> on CLOTURE!!!<\/span><\/strong><\/span><\/h2>\n

But, there are still too many Republican senators who do not understand the critical timing of defunding it NOW<\/span>.\u00a0 My own senators are in that camp, especially John McCain, who has thrown all caution to the wind and has become a shill for the Democrats in wrongly characterizing the constitutional aspects of Checks and Balances; conveniently ignoring the FACT<\/span> that it is the DUTY OF CONGRESS TO CORRECT LEGISLATIVE MISTAKES<\/span> – no matter how a majority vote passed it!\u00a0 To put it another way,<\/strong><\/span><\/p>\n

And, if the Imperial President vetoes their correction, they must override that veto, as provided in the Constitution<\/a>.

They DO pay attention – they count each signature as representing at least 2 – 3 other people who have not signed!!!\u00a0 This petition had a huge influence on the House Republicans, helping to cause their sudden unity behind defunding.<\/strong><\/span><\/p>\n

In the Courts post series I’m diligently working to publish against technical difficulties and other interruptions, I address constitutional violations in and related to Obamacare, with quotes from, and links to the Supreme Court Decision that amended the law and, then, declared the Individual Mandate to buy health insurance a tax<\/span> to pretend<\/span> that it is constitutional.\u00a0 (<\/strong><\/span>The post series<\/strong><\/strong><\/span> is rather long, and I’m having to break the original four pages into smaller parts because of the technical issues.<\/span>)<\/strong><\/span><\/p>\n

Regarding this current campaign by courageous Congressmen and Senators, to defund the legislation’s implementation, I would like to share two comments I’ve posted on Facebook, along with another author’s excellent in-depth analysis posted on Senator Jeff Flake’s Facebook Page.<\/strong><\/span><\/p>\n

I posted my<\/strong><\/span> first comment on Senator Jeff Flake and Senator John McCain’s Facebook Pages, during Senator Ted Cruz’s filibuster.\u00a0<\/strong> I thought it was respectful and non-confrontational, however, it was to removed\/hidden from Senator Flake’s page.\u00a0 [I don’t know if it is still on Senator McCain’s page; as I was scrolling through the large number of comments there, it appeared obvious that no comments are ever removed from his page!<\/strong><\/span>]<\/strong><\/span><\/p>\n

Republicans in Congress need to stand together for We the People, the Constitution, and our Nation, under God. If those who claim to be constitutionally conservative would all get on the same page – the Constitution – we could prevail handily, just as President Reagan drew Americans across party lines when they heard him speak Truth with Power and Conviction.<\/span><\/strong><\/p>\n

Americans know in our hearts what True American Liberty is, and we know it when we hear it spoken from another American Heart founded in the principles so well-articulated by our Founders in the Declaration of Independence, the Constitution and the Bill of Rights.<\/span><\/strong><\/p>\n

We know what made our Constitutional American Republic and the exceptional nation it has always been – until now. Please, Senator, stand for our Freedom to exercise our God-given Liberty, not as victims of radical progressive bullies whom we have allowed to take-over the schoolyard, and transform it from Liberty to Tyranny.<\/span><\/strong><\/p>\n

Stand for American Exceptionalism; use the means given to the Congress to overcome a bad law. Defund ObamaCare NOW, not by trying to bring a bill before a Senate that would be fresh from another victory over We the People. The time is now, before any more damage is done and before it is further entrenched by the bureaucratic system it creates. Victory comes when the momentum is swelling from the Grassroots to sweep defeat onto the trash heap of History.<\/span><\/strong><\/p>\n

Last night and this morning, I heard many examples of the Voice of Reason, as Senator Cruz, et al, expounded masterfully regarding the abomination that is Obamacare.\u00a0 These valiant Americans speak for our American Republic and for all Americans – regardless of party affiliation – who love Liberty and our Freedom to exercise it.<\/strong><\/span><\/p>\n

Please “see”: America is in grave and imminent danger of being thrown onto the Trash-heap of History, NOW!\u00a0 Not in a few months, not after the 2014 Election, not January, 2015, etc.<\/strong><\/span><\/p>\n

Thank you for reconsidering our current danger in order to choose to stand with Arizona and All of America against the Tyranny being relentlessly imposed upon this Soon-to-be Once Greatest Nation in the History of Mankind.<\/strong><\/span>

The third comment is an informed analysis of Obamacare.\u00a0 A person other than the author posted it on Senator Flake’s page, also on 9\/25\/13:<\/strong><\/span><\/p>\n

Well, I have done it! I have read the entire text of proposed House Bill 3200: The Affordable Health Care Choices Act of 2009. I studied it with particular emphasis from my area of expertise, constitutional law. I was frankly concerned that parts of the proposed law that were being discussed might be unconstitutional. What I found was far worse than what I had heard or expected.<\/strong><\/span><\/p>\n

To begin with, much of what has been said about the law and its implications is in fact true, despite what the Democrats and the media are saying. The law does provide for rationing of health care, particularly where senior citizens and other classes of citizens are involved, free health care for illegal immigrants, free abortion services, and probably forced participation in abortions by members of the medical profession. The Bill will also eventually force private insurance companies out of business, and put everyone into a government run system.<\/strong><\/span><\/p>\n

All decisions about personal health care will ultimately be made by federal bureaucrats, and most of them will not be health care professionals. Hospital admissions, payments to physicians, and allocations of necessary medical devices will be strictly controlled by the government. However, as scary as all of that is, it just scratches the surface. In fact, I have concluded that this legislation really has no intention of providing affordable health care choices.<\/span> Instead it is a convenient cover for the most massive transfer of power to the Executive Branch of government that has ever occurred, or even been contemplated.<\/span><\/strong><\/span><\/p>\n

If this law or a similar one is adopted, major portions of the Constitution of the United States will effectively have been destroyed. The first thing to go will be the masterfully crafted balance of power between the Executive, Legislative, and Judicial branches of the U.S. Government. The Congress will be transferring to the Obama Administration authority in a number of different areas over the lives of the American people, and the businesses they own. The irony is that the Congress doesn’t have any authority to legislate in most of those areas to begin with!<\/span><\/strong><\/span><\/p>\n

I defy anyone to read the text of the U.S. Constitution and find any authority granted to the members of Congress to regulate health care. This legislation also provides for access, by the appointees of the Obama administration, of all of your personal healthcare [a] direct violation of the specific provisions of the 4th Amendment to the Constitution information, your personal financial information, and the information of your employer, physician, and hospital. All of this is a protecti[on] against unreasonable searches and seizures. You can also forget about the right to privacy. That will have been legislated into oblivion regardless of what the 3rd and 4th Amendments may provide.<\/strong><\/span><\/p>\n

If you decide not to have healthcare insurance, or if you have private insurance that is not deemed acceptable to the Health Choices Administrator appointed by Obama, there will be a tax imposed on you. It is called a tax instead of a fine because of the intent to avoid application of the due process clause of the 5th Amendment. However, that doesn’t work because since there is nothing in the law that allows you to contest or appeal the imposition of the tax, it is definitely depriving someone of property without the due process of law.<\/strong><\/span><\/p>\n

So, there are three of those pesky amendments that the far left hate so much, out the original ten in the <\/strong>Bill of Rights<\/a>, that are effectively nullified<\/span> by this law. It doesn’t stop there though. The 9th Amendment that provides: The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people; The 10th Amendment states: The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are preserved to the States respectively, or to the people. Under the provisions of this piece of Congressional handiwork neither the people nor the states are going to have any rights or powers at all in many areas that once were theirs to control.<\/span><\/strong><\/span><\/p>\n

I could write many more pages about this legislation, but I think you get the idea. This is not about health care; it is about seizing power and limiting rights.<\/span> Article 6 of the Constitution requires the members of both houses of Congress to “be bound by oath or affirmation to support the Constitution.” If I was a member of Congress I would not be able to vote for this legislation or anything like it, without feeling I was violating that sacred oath or affirmation. If I voted for it anyway, I would hope the American people would hold me accountable.<\/span> For those who might doubt the nature of this threat, I suggest they consult the source, the US Constitution, and Bill of Rights. There you can see exactly what we are about to have taken from us.<\/strong><\/span>\u00a0 (Emphases added.)<\/strong><\/span><\/p>\n
